How to check the uniqueness of a company or trademark name

uniqueness of company or trademark name

When registering an s.r.o. (LLC) or another legal entity in the Czech Republic, you will have to choose a company name. There are no specific rules for choosing a name, but there are some restrictions you should know about before taking the first steps in business (like registering a domain of the same name and ordering printed advertising materials). We offer you a guide on how to check the uniqueness of a company or trademark name.

  • The company name must not contain derogatory or vulgar expressions or words that could offend someone’s dignity.
  • It is advisable to immediately check if the domain name corresponding to the company name is available.
  • Next, you must check the name for originality. If a company with such a name already exists, the notary and the registration court will not register your company. You can check the name by simply entering it on the justice.cz portal. If a company with that name already exists, you will have to come up with a new one. You could add another word or a distinctive sign to the name (e.g., register Edelweis Group instead of Edelweis), but this may adversely affect your business in the future. It’s better to be different.
  • In addition to checking the name among companies registered in the Czech Republic, you also need to check if a trademark with that name has been registered in the Czech Republic or Europe. You can check for trademark registrations at the Industrial Property Office (Úřad průmyslového vlastnictví): upv.gov.cz – databáze ochranných známek.

And one more piece of advice. When coming up with a name, don’t forget to check if it means something inappropriate in the language your customers speak.

UniMFA wishes everyone catchy and effective names.
